*Represented parties must have their attorneys submit their claims on their behalf Wildfire Recovery Compensation Program: Key Questions Q: Is participation voluntary? A: Yes. Claimants may accept or reject an offer , request a Detailed Review, or pursue litigation instead.
Q: Does filing a claim waive my rights? A: No. And receiving an offer does not waive your rights either. Any path to compensation — whether through SCE’s program, mediation or litigation — ultimately requires a settlement agreement that resolves claims.
The difference is timing, not the requirement to settle. Q: How does insurance affect an offer? A: Depending on the circumstances, what you receive in an offer may be in addition to your insurance.
See the FAQ and examples for more details. Q: Can I request a review if I think my offer is too low? A: Yes.
A claimant may introduce new information or request a Detailed Review. Economic valuation may go higher, lower or stay the same. Q: Do renters get different compensation than property owners?
A: Yes. Eligible tenants may receive compensation for their own documented losses, such as personal property and additional living expenses, while structural damages generally apply to property owners. Supporting Recovery, Fair Compensation Even after the Eaton Fire transformed their neighborhood, the Pyburns knew they were going to rebuild.
That work is now underway. The Pyburns are one of more than 100 clients that Attorney Ben Crump is helping. While no two cases are the same, he believes SCE’s program offers fast and fair resolutions for impacted residents.
The comprehensive program includes owner and tenant claims for total and partial structure loss, commercial property loss, business interruption, non-burn damage (such as smoke, soot or ash), physical injury and loss of life. Only when an offer is accepted does a claimant sign a settlement agreement, which includes the promise not to litigate further. There are no fees or added costs. Fair and prompt compensation Through Fast Pay, claimants will receive a settlement offer within 90 days of a substantially complete submission.
Payments will be made within 30 days after all conditions have been satisfied in the settlement agreement, including SCE’s receipt of it — signed and notarized. If the complexity of a claim requires analysis beyond the streamlined documentation required in the initial claim form, a Detailed Review will be available. Legal representation optional to file a claim The streamlined application allows for participation without legal counsel.
If claimants choose to be represented by counsel, their attorney must submit the claim on their behalf and facilitate communications. SCE will add 20% to the net damages portion (not including the Direct Claim Premium) of an offer to help address legal costs if a claimant is represented at the time they submit a claim. SCE will add a Direct Claim Premium to each claimant group’s offer.
This premium is in addition to the other compensation components that are part of the offer and is only available through the Wildfire Recovery Compensation Program — not litigation.
