Congress Passes Five-Year SBIR/STTR Reauthorization with $30M Breakthrough Awards

The Small Business Innovation and Economic Security Act (S. 3971) cleared Congress in March with a unanimous Senate vote and a 345-41 House tally, delivering the longest continuous SBIR/STTR authorization in recent program history. The five-year extension through September 30, 2031, replaces the uncertainty of recurring three-year cycles that forced agencies and applicants alike into planning limbo.

The bill now awaits presidential signature or automatic enactment.

New Strategic Breakthrough Awards Change the Game

The headline provision is the Strategic Breakthrough Awards program, which allows grants of up to $30 million per award — a dramatic departure from the traditional Phase I ceiling of roughly $275,000 to $305,000. Companies with prior Phase II experience can apply, but must provide 100% matching funds and commit to 48-month performance periods. Eight agencies are eligible to issue these awards: DoD, DOE, DHS, EPA, NASA, NIH, NSF, and USDA.

DoD is expected to issue the first Strategic Breakthrough solicitations in Q4 2026, with other agencies following in FY2027.

Cracking Down on SBIR Mills and Foreign Influence

Beginning in FY2027, each agency must cap the number of proposals a single company can submit annually — a direct response to so-called "SBIR mills" that flood the system with volume-over-quality applications. The legislation also expands foreign due diligence requirements, mandating screening of ownership structures, personnel affiliations, and technology licensing arrangements against eight federal watchlists, including the Entity List and the Chinese Military Companies List.

Phase III commercialization receives attention as well. Agencies must now establish standardized contracting procedures and acquisition workforce training to smooth the transition from lab to market — a persistent bottleneck that has frustrated small businesses for years.

What Applicants Should Do Before April Solicitations Drop

With DoD and NASA solicitations expected in April and NIH and NSF following in April through May, the timeline is immediate. Small businesses should audit their foreign affiliations against the expanded screening criteria, develop strategic proposal plans that account for the new per-company caps, and prepare materials for the upcoming agency solicitations.
