Business Oregon : Agricultural Overtime Repayable Award Program : Agricultural Overtime Repayable Award Program : State of Oregon Translate this site into other Languages tag, as divs are not allowed in 's --> Agricultural Overtime Repayable Award Program Agricultural Overtime Repayable Award Program In the 2023 legislative session, Business Oregon (Oregon Business Development Department, OBDD) was directed to develop and administer a repayable award program under House Bill 2058 to provide financial assistance to eligible employers to mitigate costs associated with Agricultural Overtime Law requirements.

This program will sunset on January 2, 2027 ( HB 2058, Section 3 ) therefore all recipients that are awarded after December 31, 2024 will need to pay back their repayable award by December 31, 2026 to be in compliance. Thank you.

The legislature appropriated $10 million in House Bill 2058 for the Agricultural Overtime Repayable Award Program, requiring Business Oregon to provide Repayable Awards of up to $40,000 to eligible employer applicants that fit the program criteria. The full program guidelines are available in the 'Additional Resources' section on the left-hand side of this page.

The guidelines and application are available in English, Spanish, Korean, Vietnamese, Russian and Chinese. Applicants will receive a notice of their final status after Business Oregon has completed the application review process. Please refer to the timeline section below for further information regarding when to expect a notification.

How Much is the Repayable Award? An award to any Eligible Employer will be made in an amount exceeding the lesser of: (A) The amount of overtime pay the employer anticipates incurring in the Current Year; or The employer applicant will be required to enter their estimated amount of overtime pay in the Current Year.

​*Please Note, If the total of all approved award amounts for an application period exceeds the amount of funding available in the Agricultural Overtime Award Fund, the amounts shall be reduced proportionally until the total of all award amounts does not exceed the amount of funding available. To apply for these funds, applicants must meet the eligibility criteria outlined in the program guidelines.

An employer may apply for a Repayable Award if the employer: Is eligible to apply for the Employer Tax Credit for Agricultural Worker Overtime Pay allowed under Section 8, Chapter 115, Oregon Laws 2022; and Anticipates earning not more than $3,000,000 in Gross Income in the calendar year Employer also must be doing business in Oregon under the 2017 North American Industry Classification (NAIC) System Code 111, Crop Production, or Classification System Code 112, Animal Production and Aquaculture.

Subsector that grows crops mainly for food and fiber: comprises establishments such as farms, groves, greenhouses, and nurseries that are primarily engaged in growing crops, plants, vines, or trees and their seeds. Marijuana and psilocybin are not eligible crops nor are products from them under this Repayable Award Program. See Ineligible Applicants section in the program guidelines​ .

​ Hemp is an eligible crop, and it is to be categorized as hemp only if it contains an average THC that does not exceed 0. 3% on a dry weight basis. (According to federal law, cannabis containing .

3% of tetrahydrocannabinol concentration (THC) or less on a dry weight basis is hemp, and cannabis containing more than 0. 3 percent of THC is marijuana.) Code 112 Animal Production and Aquaculture Subsector that raises or fattens animals for the sale of animals or animal products and/or raises aquatic plants and animals in controlled or selected environments for the sale of aquatic plants, animals, or their products.

The subsector compromises establishments, such as ranches, farms, and feedlots, primarily engaged in keeping, grazing, breeding, or feeding animals. ​ What is the Application Process? House Bill 2058 (2023) became effective on passage of the Legislative Assembly and signature of the Governor, on March 27, 2023.

The bill requires that Oregon Business Development Department’s (OBDD) first competitive application round for Repayable Awards open not later than 30 days after this effective date and remain open for 30 days. Repayable Award decisions and offers shall be made within 45 days following the close of the first application round. To apply, Eligible Employers will complete and submit an application for the Repayable Award.

To apply, click the "Apply Now" button located at the Agricultural Overtime Repayable Award Program page on OBDD’s website. Applications for the program will be accepted from August 21, 2023 through June 30, 2025 or the date on which the balance in the Agricultural Overtime Award Fund is less than $10,000.

A review committee, comprised of representatives from OBDD and the Oregon Department of Agriculture, will review applications and determine award offers. Employer reviews Program requirements, application, guidelines and supplemental information available on the OBDD webpage for the Agricultural Overtime Repayable Award Program and determines whether to apply. Applicant completes the application located on the Program webpage.

Applicants will have the ability to request to edit submitted applications up to the current round’s close date. All applications must be received by OBDD by the application round’s close date to be reviewed that round. A review committee will review applications and make eligibility decision.

OBDD will notify all applicants via award letters of final decisions (either approval or rejection) within 45 days of the application close date. Contracts will be issued with award letters. Recipients must complete and execute Repayable Award contracts, provided by OBDD, thereby accepting the award offer and agreeing to the terms of the award, including repayment requirements, within 30-days of contract issuance.

If the total of all approved Repayable Award amounts exceeds funding availability, award amounts for that pending round shall be reduced proportionally. OBDD will disburse Program awards after receipt of signed contracts. After award approvals, if the balance in the Agricultural Overtime Award Fund is more than $10,000, OBDD will continue to accept applications.

This application review and award offer process will continue until the earlier of the date on which all moneys in the Agricultural Overtime Award Fund have been obligated, the date the Agricultural Overtime Award Fund balance is less than $10,000 or the end date of the biennium is reached which is June 30, 2025.
