Tribal Victim Services Set-Aside (TVSSA) Formula Program

Tribal Victim Services Set-Aside (TVSSA) Formula Program is sponsored by U.S. Department of Justice, Office for Victims of Crime (OVC). This program provides non-competitive funding to federally recognized Indian Tribes, Alaska Native Claims Settlement Act (ANCSA) Regional Corporations, and their authorized designees to enhance services for American Indian and Alaska Native crime victims.

Tribal Victim Services Set-Aside | AI/AN Victim Services Resources American Indian & Alaska Native Victim Services Resources Tribal Victim Services Set-Aside Congress annually authorizes set-aside funds from the Crime Victims Fund for a Tribal Victim Services Set-Aside (TVSSA) program which provide support to Tribal communities to enhance services for victims of crime, consistent with the requirements of the Victims of Crime Act.

The Office for Victims of Crime (OVC) is charged by Congress with administering the Crime Victims Fund. OVC’s TVSSA formula grant program supports American Indian and Alaska Native communities as they walk in healing with survivors and victims of crime.

OVC FY 2026 Tribal Victim Services Set-Aside Formula Program Notice of Funding Opportunity Tribal applicants whose OVC FY 2026 Tribal Victim Services Set-Aside (TVSSA) Formula Program population certification was accepted will be notified via an email to the applicant primary points of contact and authorized representatives.

Funding under the OVC FY 2026 TVSSA Formula Program can be used to support activities such as— direct services to victims of crime; traditional healing practices; victim service program development and implementation; victim service program expansion including expanding populations served and types of crime addressed; community outreach and education about crime victimization and available services; purchasing or procuring tangible items related to victim services; support for families of missing or murdered Indigenous persons; and other activities needed to address the individualized needs of victims of any type of crime in Tribal communities.

Support for Missing or Murdered Indigenous Persons Funding under the OVC FY 2026 TVSSA Formula Program can be used to help Missing or Murdered Indigenous Persons (MMIP). Applicants may use TVSSA funds to— develop response protocols among a multidisciplinary, interjurisdictional group of agencies and organizations responsible for responding to cases of MMIP.

This could include development of an MMIP Tribal Community Response Plan related to victim services; educate the community about what to do when a loved one goes missing; educate the community about the intersection of MMIP and other crimes by combining MMIP issues into existing awareness events (e.g., awareness month activities for domestic violence, sexual assault, stalking, human trafficking); promote awareness of services available to the family and loved ones of MMIP; or help raise awareness of missing individuals from the communities they serve—when the events around their disappearance consist of any of the four circumstances above—by renting billboards; printing placards, leaflets, search instructions, maps, and other display materials; or hosting awareness walks or other commemorative events.

Construction and Renovation Efforts All applicants proposing to use TVSSA funds for renovation or construction activities must complete and upload the separate TVSSA Construction-Renovation Efforts Questionnaire in addition to the Proposal Narrative Questionnaire.

The Budget Guidance Chart provides examples of program activities and specific costs for which TVSSA grant funds may be used. Use it when developing your budget and Proposal Narrative Questionnaire (which should be consistent with each other) to describe your TVSSA program plan for OVC review. Instead of submitting a traditional program narrative and abstract, applicants will submit a Proposal Narrative Questionnaire in JustGrants.

Applicants may complete the questionnaire in JustGrants on their own OR schedule a telephone or video conference meeting with OVC staff for support in completing the questionnaire. The applicant is then responsible for submitting the information into JustGrants as part of their online application. Why don’t all Tribes get funding every year? Every federally recognized Tribe that submits an application for the OVC Tribal Victim Services Set-Aside (TVSSA) program receives a grant award. Not all Tribes apply each year.

Information about how to participate in the noncompetitive, formula grant TVSSA program is posted on OVC’s website each year. How does the Victims of Crime Act (VOCA) statute authorize DOJ to determine what services are allowable and who qualifies as a crime victim under the TVSSA from the CVF?

The VOCA statute designated OVC as the federal entity to administer the TVSSA funding, including establishing the requirements and eligibility criteria for the program. The statutory phrase “services for victims of crime” requires that beneficiaries of this program be victims of criminal victimization. Under the TVSSA program, Tribes may provide a broad range of services to crime victims.

How does DOJ decide what activities are allowed under the TVSSA? OVC’s interpretation of what is allowable under the TVSSA is very broad—essentially any service to benefit a crime victim is allowable.

For example, funding under the TVSSA Formula Program can be used to support activities such as— direct services to victims of crime; victim service program development and implementation; victim service program expansion; community outreach and education; purchasing or procuring tangible items related to victim services and other activities needed to address the individualized needs of victims of any type of crime in Tribal communities; support for Missing or Murdered Indigenous Persons (see below for additional information); and other activities needed to address the needs of a wide variety of crime victims in Tribal communities.

Because the statutory authorization for the TVSSA specifies that the funds are to be used for “services for victims of crime,” cash payments to crime victims are not allowable. What gives DOJ authority for oversight of how Tribes choose to spend these funds? How does oversight compare to the VOCA State Victim Assistance Formula Program?

All grants—including those made under TVSSA and formula grants made to states—are governed by 2 C. F. R.

§ 200, which define the requirements for government oversight of grants. TVSSA awards have certain flexibilities (e.g., in project duration) that VOCA state formula grants do not have, by virtue of TVSSA’s more flexible statutory authorization (one sentence in the annual appropriation act). OVC has sought to maximize Tribal flexibility in use of funds for victim services, where legally permissible to do so.

What guidelines around allowable grant expenditures apply to Tribes under the TVSSA and states under the VOCA State Victim Assistance Formula Grant program? Are the guidelines the same or do Tribes have more flexibility? Tribes under the TVSSA have more latitude than the states under the State Victim Assistance Formula Grant program in determining how to use their funds.

How have funds under the Tribal Set-Aside from the CVF been obligated since Fiscal Year 2018? What percentage has been to Tribes, and is that statutory?

One hundred percent of Tribal Set-Aside funding is used for Tribes—through grants directly to Tribes, grants to support Tribes through convenings such as the biennial National Indian Nations Conference, and training and technical assistance to support grantees in implementing their awards. Population Certification Form for the OVC FY 2024 Tribal Victim Services Set-Aside Formula Grant Program OVC’s Tribal Victim Services Set-Aside (TVSSA) formula grant program is dedicated to supporting the vital work of American Indian and Alaska Native Tribes in meeting the needs of crime victims.

The deadline for Federally recognized Tribes to submit their Population Certification form to signal their intent to apply for the noncompetitive FY 2024 TVSSA formula grant program funding opportunity has passed. OVC cannot accept Population Certifications after the submission deadline. All applicants will receive an email confirming receipt of their population certification form.

Population certifications will be used to determine formula award amounts for each applicant. Applicants will be invited to submit a full application under a subsequent solicitation to be released later in 2024. If you have questions, contact OVC at [email protected] .

OVC Virtual Tribal Consultation on the FY 2024 Tribal Set-Aside OVC hosted a Tribal Consultation on the Tribal Set-Aside from the Crime Victims Fund for Fiscal Year 2024 on January 17-18, 2024. The designation must be provided in writing. In preparation, OVC presented the OVC FY 2023 Crime Victims Fund Tribal Set-Aside Program report that provided a brief history of the program and how Tribal Set-Aside funds were obligated in FY 2023. Consultation on the FY 2024 Tribal Set-Aside from the Crime Victims Fund | Day 1 | January 17, 2024 OVC invited Tribal leaders, representatives, and stakeholders to participate in a Consultation on the Tribal Set-Aside from the Crime Victims Fund for Fiscal Year 2024.

OVC Orientation for FY 2023 TVSSA Grantees Undertaking Construction or Renovation Projects This webinar provides an overview of construction and renovation projects under the Tribal Victim Services Set-Aside program (TVSSA). TVSSA grantees will learn about the five construction-related special conditions and what they must do to ensure compliance with them.

Additionally, representatives from The Clark Group, the Environmental Compliance/NEPA Contractor, and Blue Trident, the Construction Project Management Training and Technical Assistance Provider, provide an overview of the services they provide to TVSSA grantees.

OVC FY 2023 Invited to Apply Tribal Victim Services Set-Aside Formula Program Tribal applicants whose OVC FY 2023 Tribal Victim Services Set-Aside (TVSSA) Formula Program population certification was accepted have been notified via an email to the applicant primary points of contact and authorized representatives.

Applicants should refer to the OVC FY 2023 TVSSA Formula Program solicitation for instructions on how to submit their application. Information about your formula allocation was emailed to the applicant primary points of contact and authorized representatives. Funding under the OVC FY 2023 TVSSA Formula Program can be used to support activities such as— direct services to victims of crime; victim service program development and implementation; victim service program expansion; community outreach and education; purchasing or procuring tangible items related to victim services; and other activities needed to address the individualized needs of victims of any type of crime in Tribal communities; support for Missing or Murdered Indigenous Persons (see below for additional information); and other activities needed to address the needs of a wide variety of crime victims in Tribal communities.

Support for Missing or Murdered Indigenous Persons Funding under the OVC FY 2023 TVSSA Formula Program can be used to help Missing or Murdered
